Welcome to ChurchFoundry. These Terms of Service ("Terms") govern your use of ChurchFoundry’s church management website, church-branded mobile apps, and related services, operated by Moriah LLC. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing our website or mobile app, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
2. Description of Service
ChurchFoundry provides church management software and church-branded member apps operated by Moriah LLC. Our platform allows you to:
- Participate in Bible studies and devotionals
- Connect with your church community
- Share and respond to prayer requests
- Join small groups and communities
- Manage church directories, attendance, volunteers, communications and forms
- Administer giving, registrations and church operations
- Participate in church events and activities
- Engage in family devotionals
3. Account Registration and Security
3.1 Account Creation
To use our services, you must:
- Provide accurate and complete information
- Be at least 13 years old (or have parental consent if under 18)
- Have the authority to enter into this agreement and, when acting for a church, to administer its data and services
- Maintain one account per person
3.2 Third-Party Authentication
You may register and sign in using third-party authentication services (Google and Apple). By doing so:
- You authorize us to access certain account information from these providers
- You remain subject to the terms and privacy policies of these providers
- You are responsible for maintaining the security of your third-party accounts
- We are not responsible for any issues arising from these third-party services
3.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of unauthorized access
- Using strong passwords
4. Community Guidelines
4.1 Expected Conduct
As a faith-based community, we expect all users to:
- Treat others with respect and kindness
- Engage in constructive and encouraging discussions
- Respect privacy and confidentiality of prayer requests
- Support fellow believers in their faith journey
- Contribute positively to the community
4.2 Prohibited Content and Behavior
You may not use our services to:
- Post hateful, abusive, or harassing content
- Share explicit, inappropriate, or offensive material

- Spam or send unsolicited promotional content

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of users who repeatedly violate community standards.

- Study notes and devotional entries

5.2 License to Use
By posting content on ChurchFoundry, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the platform to provide our services. This license applies as needed to provide the service, including retaining church records as described in our Privacy Policy.
5.3 Content Responsibility
You are solely responsible for the content you post. You represent that you have all necessary rights to share your content and that it does not infringe on any third-party rights.
6. Service Availability and Church Subscriptions
Church subscriptions and optional app services are governed by the plan, price and billing interval shown at checkout. Church administrators can manage their subscription in billing settings. Cancelling a subscription and deleting an individual member account are separate actions.
Gifts and event payments go to the church identified in the payment flow. Contact that church about designations, receipts and refund requests. Payment processing is provided by Stripe under its applicable terms.
6.1 Availability
We strive to provide:
- Reliable access to our platform
- Regular updates and improvements
- Responsive customer support
6.2 Limitations
Our services may be temporarily unavailable due to:
- Scheduled maintenance and updates
- Emergency security patches
- Third-party service outages
- Force majeure events
7. Data and Privacy
We Do Not Sell Your Data
ChurchFoundry DOES NOT sell, rent, or trade your personal information to third parties for marketing purposes. Your data is used solely to provide and improve our services.

You retain ownership of your personal data, including:
- Profile information and preferences
- Content you create and share
- Study progress and spiritual journey data
- Prayer requests and reflections

We implement security measures to protect your data:

Moriah LLC and its licensors retain their rights to:

- Licensed Bible, study and devotional materials, subject to their owners’ rights
- Platform design and user interface

We grant you a limited, non-exclusive, non-transferable license to use our services for your church’s operations and your participation in its community, subject to these Terms.

Upon termination:

- Church records, including financial records, may remain with the church after a member deletes their login
- You may request data export before termination
11. Disclaimers and Limitation of Liability

Our services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Spiritual content and guidance provided through our platform is for personal enrichment and should not replace professional counseling or pastoral care.
11.2 Limitation of Liability
To the maximum extent permitted by law, Moriah LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data or use, even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless Moriah LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to:

- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit through our services
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moriah LLC for ChurchFoundry.
